# Tenant Rights in Saudi Arabia: What the Rental Rules Guarantee, and What Landlords Can Require

A Saudi tenant’s rights come from several places: the unified Ejar contract, the Real Estate Brokerage Law, the [regulatory provisions on the landlord–tenant relationship](https://rega.gov.sa/en/media-center/news-announcements/in-line-with-hrh-crown-prince-s-directive-to-take-several-measures-to-achieve-balance-in-the-real-estate-sector-in-riyadh-approval-has-been-issued-for-regulatory-provisions-aimed-at-regulating-the-relationship-between-landlords-and-tenants/) approved on 25 September 2025, and the Real Estate General Authority (REGA) decisions that followed them. This page puts the main rights in one place, with a link to the official source at each one, and to our longer guide where a topic needs more room.

## Your Core Rights at a Glance

* **Your Ejar-registered contract is the official record.** [Council of Ministers Resolution 292](https://www.ejar.sa/ar/faqregulation) (Ejar, in Arabic) treats an unregistered lease as not valid for administrative or judicial purposes. If your landlord hasn’t registered the contract, [you can apply to register it yourself](https://rega.gov.sa/en/media-center/news-announcements/in-line-with-hrh-crown-prince-s-directive-to-take-several-measures-to-achieve-balance-in-the-real-estate-sector-in-riyadh-approval-has-been-issued-for-regulatory-provisions-aimed-at-regulating-the-relationship-between-landlords-and-tenants/).
* **A registered contract is an executive instrument.** The Execution Courts accept [the unified residential lease directly](https://www.spa.gov.sa/1784734) (SPA, in Arabic), with no lawsuit from scratch.
* **Your lease renews automatically.** [In every city in the Kingdom](https://rega.gov.sa/en/media-center/news-announcements/in-line-with-hrh-crown-prince-s-directive-to-take-several-measures-to-achieve-balance-in-the-real-estate-sector-in-riyadh-approval-has-been-issued-for-regulatory-provisions-aimed-at-regulating-the-relationship-between-landlords-and-tenants/), unless one side tells the other at least 60 days before it ends that they don’t want to renew. You can [cancel the automatic renewal without any conditions](https://www.ejar.sa/ar/faqregulation) (in Arabic), as long as you do it before the 60-day window starts.
* **Your rent can’t be raised by the landlord alone.** In Riyadh, [annual increases are suspended for five years](https://rega.gov.sa/en/media-center/news-announcements/in-line-with-hrh-crown-prince-s-directive-to-take-several-measures-to-achieve-balance-in-the-real-estate-sector-in-riyadh-approval-has-been-issued-for-regulatory-provisions-aimed-at-regulating-the-relationship-between-landlords-and-tenants/) from 25 September 2025. Elsewhere, rent changes at renewal only [through a request on Ejar that you explicitly accept](https://www.ejar.sa/ar/faqregulation) (in Arabic).
* **In Riyadh, a landlord can refuse to renew only in three cases** [set by the provisions](https://rega.gov.sa/en/media-center/news-announcements/in-line-with-hrh-crown-prince-s-directive-to-take-several-measures-to-achieve-balance-in-the-real-estate-sector-in-riyadh-approval-has-been-issued-for-regulatory-provisions-aimed-at-regulating-the-relationship-between-landlords-and-tenants/). It then comes back to you, less any documented cost of damage.
* **Extra charges belong in the contract.** Charges such as parking or cleaning [are written into the contract as a fixed amount](https://www.ejar.sa/ar/faqregulation) (in Arabic). Owners’ association fees aren’t part of the lease.
* **Breaking the rules costs money.** Anyone who violates the provisions faces [a fine of up to 12 months’ rent](https://rega.gov.sa/en/media-center/news-announcements/in-line-with-hrh-crown-prince-s-directive-to-take-several-measures-to-achieve-balance-in-the-real-estate-sector-in-riyadh-approval-has-been-issued-for-regulatory-provisions-aimed-at-regulating-the-relationship-between-landlords-and-tenants/) for the unit, plus correcting the violation and compensating whoever was harmed.

## Rent Increases and the New Rules

**Can a landlord raise the rent every year?** It depends on the city.

**Inside Riyadh’s urban boundary:** no. [The provisions suspended annual increases](https://rega.gov.sa/en/media-center/news-announcements/in-line-with-hrh-crown-prince-s-directive-to-take-several-measures-to-achieve-balance-in-the-real-estate-sector-in-riyadh-approval-has-been-issued-for-regulatory-provisions-aimed-at-regulating-the-relationship-between-landlords-and-tenants/) in the total rent of residential and commercial leases, existing and new, for five years from 25 September 2025. A vacant unit that was let before keeps the rent of its last registered Ejar contract. That ceiling [doesn’t change if the property is sold or given away](https://www.ejar.sa/ar/faqregulation) (in Arabic), and in Riyadh Ejar’s rent-adjustment request can only be used [to ask for a decrease](https://www.ejar.sa/ar/faqregulation).

**Outside Riyadh:** rent doesn’t change automatically. The landlord has to file [an adjustment request on Ejar at least 90 days before the lease ends](https://www.ejar.sa/ar/faqregulation) (in Arabic), and you can accept or reject it:

* If you accept, the lease renews at the new amount.
* If you reject it, or don’t answer before the 60-day window starts, the automatic renewal is cancelled and the lease ends at the end of its term, unless you agree a new contract.
* Any change you agree [applies to the renewed contract, not the current one](https://www.ejar.sa/ar/faqregulation).

## Notice, Renewal and Being Asked to Leave

**Can a landlord make a tenant leave?** Not whenever they like.

* **At the end of the term:** the lease renews automatically unless one side gives at least 60 days’ notice. The provisions exclude [fixed-term contracts that had 90 days or less left when they took effect](https://rega.gov.sa/en/media-center/news-announcements/in-line-with-hrh-crown-prince-s-directive-to-take-several-measures-to-achieve-balance-in-the-real-estate-sector-in-riyadh-approval-has-been-issued-for-regulatory-provisions-aimed-at-regulating-the-relationship-between-landlords-and-tenants/), and contracts the parties agree to end by mutual consent.
* **In Riyadh:** if you want to renew, the landlord can’t refuse and make you leave [except in three cases](https://rega.gov.sa/en/media-center/news-announcements/in-line-with-hrh-crown-prince-s-directive-to-take-several-measures-to-achieve-balance-in-the-real-estate-sector-in-riyadh-approval-has-been-issued-for-regulatory-provisions-aimed-at-regulating-the-relationship-between-landlords-and-tenants/): you failed to pay; the property has structural defects that affect its safety and the occupants’, confirmed by a technical report approved by the competent government body; or the landlord wants the residential unit for their own use or a first-degree relative’s. No other case can be added except by a decision of REGA’s board.
* **Outside Riyadh:** a landlord may decline to renew [without conditions, as long as they give the required notice](https://www.ejar.sa/ar/faqregulation) (in Arabic).

The 365 days apply to this ground only, not to every non-renewal.
* **Mid-term:** a landlord can’t end your registered contract on the platform alone. A mutual cancellation [is requested by one party and approved by the other](https://rega.gov.sa/media/r4shxzij/%D8%AF%D9%84%D9%8A%D9%84-%D8%AE%D8%AF%D9%85%D8%A7%D8%AA-%D8%A7%D9%8A%D8%AC%D8%A7%D8%B1.pdf), and a one-sided cancellation needs an execution decision ending the contract.

## Your Deposit

* If a deposit is taken through a real estate broker, [Article 12 of the Real Estate Brokerage Law](https://rega.gov.sa/%D8%A7%D9%84%D8%A3%D9%86%D8%B8%D9%85%D8%A9-%D9%88%D8%A7%D9%84%D9%82%D8%B1%D8%A7%D8%B1%D8%A7%D8%AA/%D8%A7%D9%84%D8%A3%D9%86%D8%B8%D9%85%D8%A9-%D9%88%D8%A7%D9%84%D9%84%D9%88%D8%A7%D8%A6%D8%AD-%D9%88%D8%A7%D9%84%D8%A3%D8%AF%D9%84%D8%A9/%D8%A7%D9%84%D8%A3%D9%86%D8%B8%D9%85%D8%A9/%D9%86%D8%B8%D8%A7%D9%85-%D8%A7%D9%84%D9%88%D8%B3%D8%A7%D8%B7%D8%A9-%D8%A7%D9%84%D8%B9%D9%82%D8%A7%D8%B1%D9%8A%D8%A9/) (Arabic text) requires it to be handed to REGA or a party it authorises and held until the property is returned undamaged. It is then returned to you, or what remains of it after the cost of damage is deducted.
* A disagreement over the deposit or the damage first goes to specialist experts designated by REGA, if both sides agree, and the two sides split their fees equally. If either side won’t accept the experts’ solution, both can go to the competent court.
* The “5% cap” you may read about is [the limit on earnest money in Article 13](https://rega.gov.sa/en/laws-and-decisions/regulations-and-by-laws/rules/real-estate-brokerage-law/) of the same law, not a limit on the deposit.

## Leaving Before the Lease Ends

A registered lease binds both sides for its full term, and the 60-day notice is about not renewing at the end of the term, not about leaving halfway through it. The easiest route is usually a mutual cancellation on Ejar, which is [free and takes effect as soon as the other side approves it](https://rega.gov.sa/media/r4shxzij/%D8%AF%D9%84%D9%8A%D9%84-%D8%AE%D8%AF%D9%85%D8%A7%D8%AA-%D8%A7%D9%8A%D8%AC%D8%A7%D8%B1.pdf) (in Arabic).

## If the Property Is Sold

In Riyadh, [a unit’s registered rent ceiling isn’t affected by a change of ownership](https://www.ejar.sa/ar/faqregulation) (in Arabic), whether by sale or gift, so a new owner can’t charge more than it. What a sale means for your existing contract itself isn’t covered by the provisions, and matters they don’t address [fall under the Civil Transactions Law](https://rega.gov.sa/en/media-center/news-announcements/in-line-with-hrh-crown-prince-s-directive-to-take-several-measures-to-achieve-balance-in-the-real-estate-sector-in-riyadh-approval-has-been-issued-for-regulatory-provisions-aimed-at-regulating-the-relationship-between-landlords-and-tenants/). Ask a specialist about your case before you decide anything.

## The Landlord’s Rights

The rules balance both sides, and landlords have clear rights too:

* **Rent paid on time.** Failure to pay is [one of the three cases](https://rega.gov.sa/en/media-center/news-announcements/in-line-with-hrh-crown-prince-s-directive-to-take-several-measures-to-achieve-balance-in-the-real-estate-sector-in-riyadh-approval-has-been-issued-for-regulatory-provisions-aimed-at-regulating-the-relationship-between-landlords-and-tenants/) in which a Riyadh landlord can refuse to renew. If rent isn’t paid when due, the landlord can [go straight to the Execution Court](https://www.spa.gov.sa/1784734) (SPA, in Arabic) with the registered contract.
* **The property returned undamaged.** The cost of damage [comes out of the deposit](https://rega.gov.sa/%D8%A7%D9%84%D8%A3%D9%86%D8%B8%D9%85%D8%A9-%D9%88%D8%A7%D9%84%D9%82%D8%B1%D8%A7%D8%B1%D8%A7%D8%AA/%D8%A7%D9%84%D8%A3%D9%86%D8%B8%D9%85%D8%A9-%D9%88%D8%A7%D9%84%D9%84%D9%88%D8%A7%D8%A6%D8%AD-%D9%88%D8%A7%D9%84%D8%A3%D8%AF%D9%84%D8%A9/%D8%A7%D9%84%D8%A3%D9%86%D8%B8%D9%85%D8%A9/%D9%86%D8%B8%D8%A7%D9%85-%D8%A7%D9%84%D9%88%D8%B3%D8%A7%D8%B7%D8%A9-%D8%A7%D9%84%D8%B9%D9%82%D8%A7%D8%B1%D9%8A%D8%A9/) (in Arabic), and the experts or the court settle any disagreement about it.
* **An objection to the set rent.** For contracts other than existing ones, a Riyadh landlord can object to the rent set under the provisions [if the unit has had substantial renovations that affected its rental value, or if its last lease was signed before 2024](https://rega.gov.sa/en/media-center/news-announcements/in-line-with-hrh-crown-prince-s-directive-to-take-several-measures-to-achieve-balance-in-the-real-estate-sector-in-riyadh-approval-has-been-issued-for-regulatory-provisions-aimed-at-regulating-the-relationship-between-landlords-and-tenants/).
* **Non-renewal with notice.** Outside Riyadh without conditions, as long as the notice is given, and in Riyadh only in the three cases.

## When Your Rights Are Breached: Where to Complain

**When can a tenant file a complaint?** When the landlord breaks the contract or the provisions. The route depends on the problem:

* **The landlord won’t register the contract:** [apply to register it yourself, and report it to REGA](https://www.ejar.sa/ar/faqregulation) (in Arabic).
* **A breach of the provisions, such as a rent increase in Riyadh:** violations go to [committees formed under Article 20 of the Real Estate Brokerage Law](https://rega.gov.sa/en/media-center/news-announcements/in-line-with-hrh-crown-prince-s-directive-to-take-several-measures-to-achieve-balance-in-the-real-estate-sector-in-riyadh-approval-has-been-issued-for-regulatory-provisions-aimed-at-regulating-the-relationship-between-landlords-and-tenants/), and the fine can reach 12 months’ rent, plus compensation for whoever was harmed. Anyone who reports a violation, other than the officials enforcing the rules, can receive a reward of up to 20% of the fine collected if their information leads to a final decision.
* **A dispute over the deposit or damage:** [experts designated by REGA](https://rega.gov.sa/%D8%A7%D9%84%D8%A3%D9%86%D8%B8%D9%85%D8%A9-%D9%88%D8%A7%D9%84%D9%82%D8%B1%D8%A7%D8%B1%D8%A7%D8%AA/%D8%A7%D9%84%D8%A3%D9%86%D8%B8%D9%85%D8%A9-%D9%88%D8%A7%D9%84%D9%84%D9%88%D8%A7%D8%A6%D8%AD-%D9%88%D8%A7%D9%84%D8%A3%D8%AF%D9%84%D8%A9/%D8%A7%D9%84%D8%A3%D9%86%D8%B8%D9%85%D8%A9/%D9%86%D8%B8%D8%A7%D9%85-%D8%A7%D9%84%D9%88%D8%B3%D8%A7%D8%B7%D8%A9-%D8%A7%D9%84%D8%B9%D9%82%D8%A7%D8%B1%D9%8A%D8%A9/) (in Arabic) first, then the competent court.
* **A dispute arising from an Ejar lease:** REGA’s [Saudi Real Estate Arbitration Center](https://rega.gov.sa/en/rega-services/platforms/saudi-real-estate-arbitration-center/) offers arbitration, conciliation and settlement online for cases arising from Ejar. Read its procedural rules and filing requirements before you apply.
